ORDER BELOW EXH.01
Accused absconding since last so many years after recording his plea.
Thereafter no cross order is also passed against accused. The statement of
accused to be recorded U/sec 313 of CRPC was also dispensed with by Ld.
Predecessor. There is no bail papers or order on record to release the accused
on bail or PR bond. However, his plea is recorded at Exh.8 on 08.08.2018.
Complainant has adduced evidence. Matter is pending unnecessarily
for securing presence of the accused which is not warranted for advancing
arguments. Hence I passed following order.
ORDER
1. Issue standing NBW against the accused to be served through
concerned police station.
2. The advocate for complainant and advocate for accused to argue
the matter finally on next date.
3. Matter being more than 5 years old, complainant to take necessary
effective steps for the conclusion of matter failing which the same
would be dismissed for want of prosecution.
4. Order be uploaded on CIS for the knowledge of parties.
