ORDER BELWO
(Application for Return of Property)
The present application is filed under Section 457 of Code of
Criminal Procedure for return of articles to the informant seized during
investigation. Accused persons/respondents seriously disputed the claim
of the applicant over the articles seized. The offence is triable by Court of
Session. The record shows that the articles have some evidentiary value
and this court has got no jurisdiction to enter into that aspect. Therefore,
applicant shall approach Session Court for obtaining necessary orders.
Without passing any order on merit, following order -
