demand draft of cheque amount on the day of appearance as per
the summons. Complainant accepted said cheque. Complainant’s
request for keeping pending file on the aspect of interest and
compensation rejected. Accordingly, complainant has filed
withdrawal application at Exh.16. As accused have paid the
cheque amount on first day of hearing and appearance after
issuing summons, the proceeding needs to be closed. Hence, I pass
following order.
ORDER
1. Complaint stands dismissed as withdrawn.
2. The accused are acquitted of the offence punishable
u/sec.138 of The Negotiable Instrument Act.
3. Proceeding stands closed.
4. Order dictated and pronounced in open court.
