ORDER BELOW APPLICATION FOR REGISTRATION OF BIRTH
1] This is an application filed by applicant Yashoda Raju Sonavne
with contention that her daughter namely 'Aasha' was born on 05/01/2016 at
home i.e. Indira Nagar No.3, Dharavi, Mumbai 17. Due to unaware of legal
procedure the birth of daughter of applicant could not get registered with
B.M.C. authorities.
2] The respondent i.e. Medical Officer of Health, G/North Ward,
Dadar W, Mumbai has filed report and submitted that the birth of 'Aasha' born
on 05/01/2016 to Smt. Yashoda Raju Sonavne and Shri. Raju Sambhaji
Sonavne is not reported with their office. The said officer further submitted
that to scrutinize the case and necessary order be passed.
3] Alongwith this application, the applicant has filed on record her
affidavit stating every facts as per her application and enclosed verified copies
of Election Card, PAN Card, Aadhaar Card, medical papers. Also, the applicant
has filed on record affidavits of witnesses Rajana Sambhu Katke and Jijabai
Rakamaji Sadafule wherein on oath stated to have been present at the time of
birth of Aasha daughter of applicant on 05/01/2016 at house of applicant.

4] On perusing the application, documents, affidavit of the applicant
in support of the application, affidavits of witnesses and report of BMC, this
Court does not find any hesitation to accept that 05/01/2016 is true and
correct date of birth of applicant. Hence, proceed to pass following order.
ORDER
1 The application is allowed.
2 The concern authority 'The Registrar, Birth and Death, G/North
Ward, Dadar (W), Mumbai – 400 028' is directed to take entry of the date of
birth i.e. 05/01/2016 (Fifth January Two Thousand Sixteen) of 'Aasha'
daughter of applicant Mrs. Yashoda Raju Sonavne and Mr. Raju Sambhaji
Sonavne, in their register on accepting the fees as per the rules.
