ORDER BELOW EXH.01
1. The accused and her advocate present. The
complainant and advocate absent.
2. Perused proceedings. The affidavit in lieu of
examination in chief of the complainant is filed on 11.07.2018.
Thereafter the complainant was recalled to face cross examination
vide order dated 05.12.2019. The complainant has received the
costs of Rs.3,000/ on 05.03.2021. Thereafter, it seems that the
complainant has not remained present for facing cross
examination by the accused. The Ld. Advocate for the accused
submitted to close evidence of the complainant. However, one
opportunity needs to be given to the complainant. Hence, I pass
following order.
ORDER
1. The complainant to remain present on next date for
facing cross examination, failing which the complaint
would stand dismissed assuming that the complainant is
not interested in proceeding with the matter.
2. The matter is adjourned till 29.08.2023.
