ORDER BELOW APPLICATION EXH.15
This is an application for issuing Proclamation warrant against accused
Nos.2 to 5.
2. Heard advocate for complainant.
3. Perused warrant report. It shows that accused is deliberately avoiding
their presence for protracting trial. Already accused have engaged advocate
but nobody turning up before the court. Unless presence of accused is
secured for recording plea, matter will not be proceeded further. From the
documents on record there is reason to believe that accused and their
advocate Mr. P.J.Purohit, Mr. Manoj Mali, Ms. Payal Panjawani are
deliberately playing dilatory tactics. The report or Non Bailable Warrants are
sufficient to draw an inference as such. No option left than to issue
Proclamtion Warrant against accused for securing presence. Hence, I passs
following order.
ORDER
1. Issue Proclamation Warrants under section 82 of Code of Criminal
Procedure against accused No.2 to 5 to be served through
concerned Police Station.
2. Complainant is directed simulteneously to publish copy of
Proclamation Warrant issued against accused in Well Circulated
News Paper of residential area of the accused and shall file the
same on record.
3. Order dictated and pronounced in open court.
4. Order be uploaded on Court Web Portal.
