ORDER BELOW BAIL APPLICATION, EXH.
1. Perused record. Heard both the sides.
2. The accused prayed for bail mainly on the ground that he is poor
and innocent. Investigation is over and he is ready to remain abide by the
conditions, if any, imposed, etc. Ld. A.P.P. objected to it stating that
though investigation is over allegations are serious and there is possibility
of tampering.
3. Accused is in custody since long. Investigation relating to accused
is over and charge sheet already filed. There is doubt over the
applicability of Section 326 of Indian Penal Code. Other accused are
already on bail. Offence is triable by this Court itself. Accused is ready to
remain abide by the conditions. The conclusion of trial will take much
time. Considering all these aspects and facts and circumstances and
reasons assigned in the bail application following order -
ORDER
a. Application is allowed.
b. Accused Mr. Naseem Shakil Khan, is released on bail on his
furnishing P.B. and S.B. of Rs.7,000/-. Permission granted to deposit cash
security instead of surety bond.
c. Accused person shall furnish his detail address and proof thereof.
