REASONS
1 The accused is tried for the offence punishable u/sec. 406 of
Indian Penal Code.
2 Accused is produced before me. Charge is framed against him, to
which he voluntarily pleaded guilty. He is in jail since 31.05.2018. Heard
accused in person. He submitted that lenient view may be taken as he is
only earning members in his family. Considering the nature of offence, I
accept his plea and proceed to pass following order :
ORDER
i) Accused Mohd. Ashraf Shaikh @ Aslam Suleman Shaikh
convicted vide section 248 of Criminal Procedure Code for
the offence punishable u/sec. 406 of Indian Penal Code and
he is sentenced to suffer R.I. for 7 months and fine of
Rs.1000/, in default of payment of fine, he shall undergo
R. I. For 15 days.
ii) The accused is in custody since 31.05.2018 He is entitled to
get benefit of set off for the period of detention already
undergone vide under section 428 of Cr.P.C.
iii) Muddemal property i.e. Bajaj company autorickshaw
bearing No. MH02DK7511 , be returned to informant, as
per law, after appeal period is over.
iv) Copy of this judgment be supplied to the accused free of cost.
