ORDER BELOW APPLICATION FOR REGISTRATION OF BIRTH
1] This is an application filed by applicant Shahina Parveen
Riyajuddin Sayyed with contention that her son namely 'Mohammed Zafar' was
born on 16/03/2005 at home at the above mentioned address. Due to
negligence and unawareness of B.M.C. rules the applicant could not get
registered the birth of her son with B.M.C. Office.
2] The respondent i.e. Medical Officer of Health, H/West Ward,
Bandra W, Mumbai has filed report and submitted that the birth of Mohammed
Zafar Mohammed Haider Khan born on 16/03/2005 is not found reported with
their office.
3] Alongwith this application, the applicant has filed on record her
affidavit stating every facts as per her application and enclosed copies of her
Aadhaar Card, electricity bill and Aadhaar Card of her son. Also, the applicant
has filed on record affidavits of witnesses Mrs. Nazneen Riyazuddin Sayed and
Mr. Mohd. Meraj Ansari wherein on oath stated to have been present at the
time of birth of Mohammed Zaf ar Mohammed Haider Khan son of applicant
on 16/03/2005 at house of applicant. Verified Aadhaar Card copies of
witnesses are filed on record as proving of their identify and address.

4] On perusing the application, documents, affidavit of the applicant
in support of the application, affidavits of witnesses and report of BMC, this
Court does not find any hesitation to accept that 16/03/2005 is true and
correct date of birth of son of the applicant. Hence, proceed to pass following
order.
ORDER
1 The application is allowed.
2 The concern authority 'The Registrar, Birth and Death, H/West
Ward, Bandra (W), Mumbai – 400 050' is directed to take entry of the date of
birth i.e. 16/03/2005 (Sixteen March Two Thousand Five) of 'Mohammed
Zafar Mohammed Haider Khan' daughter of applicant Mrs. Shahina Parveen
Riyajuddin Sayyed and Mr. Mohammed Haider Sharif Khan, in their register on
accepting the fees as per the rules.
