Complainant’s authorized representative absent. Several
adjournments granted for taking steps till today. Already last chance
was granted vide order dated 30.10.2025 but complainant failed to
take appropriate steps to secure presence of the accused.
2. Complainant or its respective officers are not seems to be
really interested in proceeding with the complaint. No steps taken to
secure presence of the accused since 11.12.2019 despite giving
sufficient opportunity. Keeping the file pending years together without
proceeding further by the complainant is unjustified. Hence, I pass
following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Code of Criminal Procedure and section 279 of
Bharatiya Nagarik Suraksha Sanhita, 2023.
2. Accused are acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
