ORDER PASSED BELOW EXH.1 This application is filed by the applicant namely Haseen Abdul Khan for release of autorickshaw bearing No.MH47AJ5468, which is seized by the Excise Department in connection with Crime No.282/2021 registered with the Excise Department for the offence punishable under section 65(A), (E) of Bombay Prohibition Act. 2) Say was called from I. O. and A.P.P. They both have strong objection and submitted that it is used for transportation of liquor and it is essential at the time of trial. They both prayed for rejection. 3) In support of his contention regarding ownership, applicant has filed on verified copies of RC book, Aadhar card and xerox copy of insurance certificate & permit letter alongwith his affidavit. The applicant is directed to produce fitness certificate of said autorickshaw from 07.12.2021. But till today, the applicant miserably failed to comply the -- 1 of 2 -- 2 order. The applicant failed to file verified copy of fitness certificate of auto rickshaw. The RC book shows registered validity as 'See F Cert'. Therefore, he is not entitled to get the custody of the vehicle. Under such circumstances, I pass following order : :: O R D E R O R D E R :: Application is rejected. Date : 22.12.2021 ssl. (Smt.
