ORDER BELOW EXH.01
1. This is an application for condonation of delay of 11 days
caused to file the complaint under section 138 of Negotiable Instrument Act.
2. It is contended that applicant due to technical glitch online filling
could not be done within stipulated time and therefore the delay has been
caused in filing the complaint.
3. The opponent duly served but failed to file say.
4. The reason shown for delay is genuine. The delay is probable
and satisfied. Further, the delay is not intentional nor it will take away the
statutory right of the complainant/applicant. Hence, I pass following order.
O R D E R
1) The delay stands condoned in the interest of justice.
2) The complaint be registered as per Rule.
3) Order dictated and pronounced in open court.
