Order Below Bail Application
Perused bail application and say. Heard both side.
Initially on 21.04.2025, the offence punishable under Section
109(1) of BNS and Section 37(1)(a), 135 of Maharashtra Police Act,
was registered exclusively against accused Shubham Kori. The
allegation is that accused Shubham Kori, has attempted to commit
murder of informant. Later on during investigation it was reveled to I.O.
that the accused Jitendra Kori, has concealed the accused Shubham
Kori. Hence, offence punishable under Section 249 of BNS is added vide
report dated 03.06.2025. The F.I.R. and all the reports of I.O. shows that
there is no allegation of attempt to murder or participation in the said
crime or common intention against accused Jitendra Kori. Admittedly,
accused Jitendra Kori, has not committed the offence punishable under
Section 109 of BNS, 37 (1)(a), 135 of Maharashtra Police Act. As per
the case of prosecution accused Jitendra Kori, has committed only
offence punishable under Section 249 of BNS. He is not charged for
Section 3(5) of BNS by the I.O. Resultantly, the clear case of prosecution
that the accused Jitendra Kori has committed offence punishable under
Section 249 of the BNS. Section 249 of BNS is bailable and triable by
this court. Therefore, the accused Jitendra Kori is entitle to enlarge on
bail. Accordingly, I proceed to pass the following order -
ORDER
1. Accused is released on furnishing P. B. of Rs.10,000/- and on
deposit of cash bail of Rs.15,000/- (Rupees Fifteen Thousand

only).
2. Accused to submit his address proof.
3. Accused shall not tamper the evidence and shall not pressurize
the prosecution witnesses.
4. Accused shall not leave India without prior permission of the
Court till conclusion of the trial.
5. Accused is directed to remain present each and every date and
in default his bail bonds would automatically forfeit.
6. Accused is directed to attend the Dharavi Police Station on
every Monday in between 10.00 am to 12.00 noon till the filing
of charge-sheet or until further order, whichever is earlier.
7. Accused shall not misuse the liberty.
8. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
