Perusal of record would indicate that, the applicant
remaining absent since last few dates and even today. The presence
of applicant is essential for the hearing of the application. The
respondent on 04.12.2018 filed on recored the pursis informing that
he has entered into a settlement with the applicant before the Family
Court in the marriage petition bearing No. 88/2018. It is thus found
that the applicant has lost interest from the proceeding owing to such
settlement. Despite having waited for reasonable period, the
applicant failed to appear. Hence, no reason to adjourn the
proceeding further. Hence, case is dismissed, for want of prosecution
on the part of applicant.
