The complainant and advocate absent since last so many
dates. The case is pending since year 2018. Despite passing specific
order dated 29.07.2025, no steps taken to secure presence of the
accused by the complainant since year 2023. It seems that complainant
has lost interest in proceeding with the matter and as such not taking
steps till date. Keeping the file pending years together without
proceeding further taking appropriate steps by the complainant is
unjustified.
2. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case.
Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Code of Criminal Procedure and section 279 of
Bharatiya Nagarik Suraksha Sanhita, 2023.
2. Accused is acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
