Perused the application and say filed by the complainant.
By moving the present application the accused has prayed for time to
pay the amount to the complainant with monthly installments of
Rs.2,50,000/- each commencing from 10th August, 2026. It is the
contention of the accused that, he has paid 60% amount i.e. Rs.30
Lakhs. Rs.20,00,000/- is yet to be paid. For payment of unpaid
amount he has prayed for monthly installment. He is also ready to
pay Rs.5,00,000/- as an interest on the said unpaid amount. The
application is strongly resisted by the complainant.
2. Heard both sides at length. Gone through the documents
on record. The record reflects that, the matter was referred to the
mediation. The dispute between the parties is settled by way of
mediation. It is not disputed that, amount of Rs.30 Lakhs have been
paid to the complainant. Rs.20 Lakhs is yet to be paid. The only
question is about the installments. The accused is ready to pay

Rs.5 Lakhs towards interest on the due amount. In order to pay Rs.25
Lakhs it will take 10 installments. Since the accused is ready to pay
Rs.5 Lakhs towards interest, it is just and appropriate to grant the
accused some installments in order to pay the remaining amount. No
prejudice would cause to the complainant as the accused is ready to
compensate by paying some extra amount as fixed in the settlement.
Thus, the application deserves to be allowed. Hence, the following
order:
ORDER
1) The application is allowed.
2) The accused shall pay each and every installment within time
to the complainant.
3) He shall file written undertaking before this Court about the
said compliance.
4) The accused shall endeavor to pay the remaining amount to
the complainant as early as possible.
5) The application is disposed of accordingly. Parties to take
note.
