ORDER BELOW APPLICATION FOR DIRECTION TO ISSUE PASSPORT
1] The present application is filed by applicant/accused Rajesh
Suresh Kunchikurve in C.R. No.98/2018 for direction to issue passport.
2] It is stated that the applicant made an application for issuance of
passport to the passport authority on 29/05/2018. The applicant wishes to
travel abroad.
3] On the application say of respondent was called. The Investigating
Officer has filed say and submitted that he has no objection to grant permission
for issuing passport as investigation is completed and chargesheet will be filed.
While Ld. APP filed say and submitted that the copy of F.I.R. and chargesheet
not attached. The stage of case is not mentioned in the application. There is
likelihood accused may abscond if passport is obtained. There will be dealy in
trial. Hence, prays for rejection of the application.
4] Perused the application, say of Investigating Officer and Ld. APP
and affidavit in support of application. Also, perused the documents filed on
record. Heard advocate for applicant/accused and Ld. APP for state. I do not
find that the progress of the case would hamper, if the permission is given to
the accused / applicant for getting the passport. Therefore, concerning with the
prayer of the applicant/accused about issuance of passport is granted. Hence,
the following order.
ORDER
a] The application is allowed.

b] The applicant/accused Rajesh Suresh Kunchikurve is hereby given
no objection for applying to get the passport, the passport authority be
considered the application in accordance of law with direction to applicant that
whenever he travel abroad the permission be obtained from the court and
intimation of his traveling abroad be given to court.
