I solemnly affirm on oath that -
My name is Sonali Sunil Shinde
Age : 47 years, Occupation : Housewife.
R/o. Ahinsa Nagar, Bandra(E), Mumbai.
Examination-in-Chief of DW-02 by advocate Mahesh Kadam for the
accused :
1. Accused is my husband. Complainant is my neighbor.
Complainant has no concern with my husband. She used to visit me at
my home. There is no transaction at all in between us and complainant.
The address mentioned in the title clause of complaint against name of
my husband is incorrect. No notice was received in absence of accused
at our home. My husband has not given any cheque to the complainant.
I do not want to say anything more. I do not know anything about
complaint filed by complainant.

Further cross examination of DW-02 by Adv.R.M.Kamble for the
complainant:
3. We are residing at 10, Ahinsa Nagar, Paramhans Marg, Bandra
(E), Mumbai-51. It is not true to say that building No.10 of
Government Colony at Ahinsa Nagar towards East of the Ahinsa Nagar.
It is towards West side. The Clinic of Dr. Pol is at a distance of two
minutes from my home. We are staying at Ahinsa Nagar locality since
last 28 years. I do not know that whether any other person by name
Sunil Shinde stays in Ahinsa Nagar Colony. I am knowing complainant
since my marriage. My relations with complainant are cordial and close
one. It is not true to say that we had money transaction. I do not know
for what purpose present complaint is filed by complainant Swagata.
The signature on the cheque does not belong to my husband. Now I am
shown Referral Order for Mediation. The signature on said Referral
Order belongs to my husband. It is not true to say that complainant
sent notice to us and my husband received it. It is true to say that
everybody in the colony is known my husband by name. We used to
keep cheque book on the table. Said cheque book is misplaced. I do not
know how the cheque of my husband came in the custody of the
complainant. I can not say that she had stolen it. My husband has not
filed complaint to police after knowledge about the present complaint. I
have not advised him to make police complaint against complainant. It
is not true to say that there was transaction in between my husband
and complainant. It is not true to say that against said liability my
husband issued subject cheque to the complainant. It is not true to say

that I am deposing false.
