I solemnly affirm on oath that -
My name is Sunil Mahadev Shinde
Age : 54 years, Occupation : Driver.
R/o. Bandra(E), Mumbai.
Examination-in-Chief of DW-01 by advocate Mahesh Kadam for the
accused :
1. I know complainant as she is my neighbour. We had
visiting terms. No transaction ever taken place in between me and
complainant. I collected the notice sent by complainant from post
office. I again say I collected the summons of the court from the post
office. The postman is my friend. He informed me about the Registered
Post Summons. Summons was not sent on my residential address. The
notice sent by complainant was also obtained from post office. It was
not sent on my residential address.
2. Now I am shown cheque Exh.10. The name, amount in
words and figure and date and signature on the cheque is not my hand
writing or my signature. I have not executed said signature on the
cheque Exh.10. Signature does not belong to me. The cheque belongs
to my account.
3. Now I am shown office copy of notice Exh.12. The
address mentioned on the notice is not the correct address. Said
address is incorrect address. My correct address is Room No.10, Ahinsa
Nagar Co-operative Housing Society, Ram Krishna Parmahans Marg,
Government colony, Bandra(E), Mumbai-51.
4. Now I am shown Acknowledgment Card Exh.14. It does
not bears my signature. I do not know anything about acknowledgment

card. I have not obtained any friendly loan from complainant. There is
no transaction in between me and complainant. I have not given
cheque Exh.10 to the complainant. I came to know about depositing
said cheque in bank when I received summons of the court. I am falsely
implicated in the case.
