ORDER BELOW APPLICATION EXH.28 FOR BAIL AFTER CONVICTION
Read application for releasing the accused on bail till filing
Appeal against the Judgment and Order of Conviction.
2. Section 389(3) of Code of Criminal Procedure empowers to
release the convicted person on bail who intends to present the appeal.
Accused has right to challenge the impugned Judgment and Order of
Conviction passed against him. He was on regular bail during trial. He
is ready to deposit part amount of fine. Accused is a Rickshaw Driver.
Considering his financial status, it would be just and proper to accept
the request to release the accused on continuation of earlier cash bail
amount. Hence, I pass following order.
ORDER
1) Application for bail allowed till appeal period.
2) Accused is provisionally released on bail on executing
and furnishing his PB and SB of Rs.10,000/- with
condition to deposit Rs.10,000/- towards part amount of
fine/compensation till appeal period. Cash bail deposited
earlier by the accused is continued and the same be
considered as cash security for this application.
3) Order be uploaded on Court Web Portal.
