1. Complainant and his advocate absent since last so many
dates. The complainant absent despite passing specific order dated
28.08.2023 below Exh.01. The matter is pending since year 2018.
Keeping the file pending years together without proceeding further
taking appropriate steps by the complainant is unjustified. Accused has
also right of speedy trial.
2. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case.
Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Cr.P.C.
2. Accused is acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
