ORDER BELOW APPLICATION FOR NO OBJECTION FOR
ISSUANCE PASSPORT
1] The present application is filed by applicant/accused Ashish H.
Bhoite in C.R. No.237/2017 for seeking no objection to issue passport. It is
stated that the applicant made an application to passport authority for issuance
of passport but concerned police station directed to obtain NOC for issue
passport from court.
2] On the application say of respondents was called. The Senior
Police Inspector of Dharavi police station has filed say and raised objection to
issue passport as investigation is in progress. If permission granted to accused
he will be absconding and will not be available in the trial. Hence, opposed the
application. While Ld. APP filed say and submitted that the accused may be
directed to attend Hon'ble Court as and when required. The application is only
for issuance of passport. There is likelihood he may abscond. The accused may
be directed to obtain the permission of the court to go to abroad. Hence,
opposed the application.
3] Perused the application, say of Investigating Officer and Ld. APP.
Also, perused the documents filed on record. Heard Ld. APP and advocate for
applicant/accused. I do not find that the progress of the case would hamper, if
the permission is given to the accused / applicant for getting the passport.
Therefore, concerning with the prayer of the applicant/accused about issuance
of passport is granted. Hence, the following order.
ORDER
a] The application is allowed.

b] The applicant/accused Ashish H. Bhoite is hereby given no
objection for applying to get the passport, the passport authority be considered
the application in accordance of law with direction to applicant that whenever
he travel abroad the permission be obtained from the court and intimation of
his traveling abroad be given to court.
