ORDER BELOW APPLICATION FOR REGISTRATION OF DEATH.
1] The said application is filed by applicant Sanjay Yankappa
Kunchikurve in context of his mother Durgamma Yankappa Kunchikurve who
expired on 15/02/2017 at home due to illness. Due to ignorance of law the
applicant could not get register death of his mother Durgamma Yankappa
Kunchikurve to the concerned department within stipulated period.
2] The respondent i.e. Medical Officer of Health, G/North Ward,
Dadar W, Mumbai has filed report and submitted that the death of deceased
Durgamma Y. Kunchikurve on 15/02/2017 is not registered with his office.
3] Alongwith this application the applicant has filed on record his
affidavit stating every facts as per his application and also enclosed verified
copies of his Aadhaar Card, ration card, Aadhaar card of deceased Durgamma
Yankappa Kunchikurve, medical certificate of cause of death of late Durgamma
Yankappa Kunchikurve on 15/02/2017. Also, the applicant has filed on record
affidavits of Mrs. Laxmi Yallappa Deraber and Mr. Malkappa Yanappa

Kunchikurve – who being neighbours of the applicant have on oath stated that
deceased Durgamma Yankappa Kunchikurve expired at her residence. Verified
Aadhaar Card copies of witnesses are filed on record as proving of their identify
and address.
4] On perusing the application, affidavit, documents of the applicant
in support of his application, affidavits of witnesses and report of BMC, this
Court does not find any hesitation to accept that 15/02/2017 is true and
correct date of death of Durgamma Yankappa Kunchikurve – mother of
applicant. Hence, proceed to pass following order.
ORDER
1 Application is allowed.
2 The concern authority 'The Registrar, Birth and Death, G/North
Ward, Dadar W, Mumbai400 028 is directed to take entry of the date of death
i.e. 15/02/2017 (Fifteen February Two Thousand Seventeen) of Late Mrs.
Durgamma Yankappa Kunchikurve – mother of the applicant Mr. Sanjay
Yankappa Kunchikurve, in their register on accepting the fees as per the rules.
