MS JAY ENTERPRISES IN THE COURT OF METROPOLITAN MAGISTRATE, 58TH COURT, BANDRA, MUMBAI ORDER BELOW EXH.01 1. Today the matter is posted for cross examination of the complainant. The complainant and advocate absent. The accused absent but his advocate present. He submitted that the complainant is not remaining present. Perused proceeding. Evidence affidavit is filed on 08.08.2018. Thereafter the complainant has filed application for withdrawal of the complaint at Exh.30 on 18.07.2019. The application is still pending for order. However, it would not be just and proper to dismiss the complaint in absence of the complainant and without uploading any order for the knowledge of the complainant on CIS. The COVID 19 pandemic started after few months of said order. There is reason to believe that the complainant either might have settled the dispute out of court or lost interest in proceeding with the matter. Hence, I pass following order. ORDER 1. The complaint to remain present on next date. Failing which the complaint would stand dismissed as withdrawn as per application Exh.30. -- 1 of 2 -- 2 C.C.NO.1109/SS/2018 Exh.01 2.
