ORDER BELOW EXH. NO.5
The applicant has filed the interim application against the
respondents and sought the relief of protection order to prohibit the
respondent from alienating any assets including gold and silver
ornaments and all the household articles given to applicant at the time
of marriage by the parents and relatives. She further sought the relief of
resident directing the respondents to secure alternate accommodation or
to pay rent. She sought maintenance of Rs.20,000/- per month and
compensation of Rs.10 lakhs.
2. Perused application and say of respondent. Heard both side.
3. Admittedly, now the applicant is residing with her parents and the
respondent No.1 is having custody of their child. It is not disputed that
the respondent No.1 is OLA driver. Nothing on record to show that the
applicant has source of income. The respondent No.1 has the
responsibility to maintain his son. According to applicant the salary of
respondent No.1 is Rs.35,000/- per month. Per contra respondent No.1
claimed that his salary is Rs.14,000/- per month. However, both have
not filed his salary certificate. The statement of bank account of
respondent No.1 shows that he is sufficiently earning and frequently
amounts are credited to his bank account. Considering all these
documentary evidence, I found the respondent No.1 shall pay Rs.6,000/-
per month to the applicant.

4. To adjudicate the other reliefs in respect of assets and movable
properties and the compensation, detail evidence is necessary. After
appreciation of detail evidence said issue can be adjudicated.
5. Hence, I proceed to pass the following order -
ORDER
a. Application is partly allowed.
b. The Respondent No.1 shall pay Rs.6,000/- per month to applicant
for her maintenance from the date of filing of this case till the final
disposal of this case.
c. Rest reliefs are rejected.
