This application is filed by the applicant namely Tauhid Patel
for release of Suzuki Burgman Street/UB125 motorcycle, mobile & other
documents, which are seized by the Kherwadi police station in connection
with Crime No.392/2021 registered with the Kherwadi police for the
offence punishable under section 353, 332, 506 of I.P.C.
2) Say was called from I. O. and A.P.P. The I.O. has no objection.
The Ld. APP has an objection and submitted that said muddemal is required
at the time of trial. She prayed for rejection.
3) In support of his contention regarding ownership, applicant has
filed on record xerox copies of FIR, bail order, Ration Card, passport &
driving licence alongwith his affidavit. The applicant has not given his
vehicle number and mobile model description. Furthermore, the applicant
has not given any details of document. He failed to file verified copy of RC
book of motorcycle & other relevant documents on record. Therefore, he is
not entitled to get the custody of seized muddemal. Under such
circumstances, I pass following order :
