REASONS
Both accused are produced before me through video conference.
Charge is framed against them, to which they voluntarily pleaded guilty.
Said accused are in jail since 08.10.2021 and 12.10.2021 respectively.
Heard accused in person. They submitted that lenient view may be taken as
they are only earning member in their family. Considering the nature of
offence, circumstances under which it is committed, antecedents of the
accused, their age and the period of detention already undergone, I proceed
to pass following order :
ORDER
i) Accused No.1 Sohel @ Shanu Hamid Shaikh and accused
No.2 Mujmmil Iqbal Shaikh @ Tangad are convicted under
section 241 of Criminal Procedure Code for the offence
punishable u/sec. 457 of Indian Penal Code. They are
sentenced to suffer R.I. for 45 (Forty Five) days each, and
fine of Rs. 200/ (Rupees Two Hundred only) each, in
default of payment of fine, they shall undergo further S.I. for
2 (Two) days each.
ii) Accused No.1 Sohel @ Shanu Hamid Shaikh and accused
No.2 Mujmmil Iqbal Shaikh @ Tangad are convicted under
section 241 of Criminal Procedure Code for the offence
punishable u/sec. 380 of Indian Penal Code. They are
sentenced to suffer R.I. for 1 (One) month each, and fine of
Rs. 200/ (Rupees Two Hundred only) each, in default of
payment of fine, he shall undergo further S.I. for 2 (Two)
days each.
iii) All sentences shall run concurrently.
iv) Accused No.1 & 2 are in jail since 08.10.2021 & 12.10.2021
respectively. They are entitled to get benefit of set off for the
period of detention already undergone vide under section
428 of Cr.P.C.

v) Seized gold ingot be forwarded to India Government Mint
office and iron sickle be forwarded to District Collector,
Mumbai.
vi) Copy of this judgment be supplied to the accused free of cost.
