ORDER BELOW EXH.-1
Heard both parites. Matter is pending since 2023 interim
application yet to decide. Parties yet to file certain documents
pertaining to their income affidavits pertaing to Assets and Liabilities.
Ld. Counsel for respondent by way of this application seeking direction
be given to applicant to follow mandate of judgment of Hon’ble Apex
Court in the case of Rajnish V/s. Neha specifically Part I to Part VIII and
Part A, B, C. Applicant filed say and submitted that, she has filed her
income affidavit on 02/07/2026. Therefore, the application of
respondent become infractious.
2. Record reflects that, the applicant filed Two income
affidavits. Applicant to decide which is valid and legal. Moreover in the
interest of justice it is directed to both parties to follow the direction
given in the judgment of Rajnish V/s. Neha AIR 2021 SRC 569. Both
parties is hereby directed to submit documents pertaining to their
income affidavits till next date till next date and argue on interim
application without fail.
