ORDER BELOW EXH.1
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property.
2. As per applicant the cellular phone mentioned in the application is
seized by respondent in connection with an offence registered with
respondent police station at C.R. No.884 of 2021, for an offence punishable
under Sections 307, 395, etc. of Indian Penal Code and other acts. The
investigating relating to article is completed. Therefore, he filed present
application for handing over custody of stolen article.
3. Say of the respondent was called. The Investigating Officer has no
objection to handover the property to the applicant. Ld. A.P.P. has objected
to it. The investigating relating to mobile is completed. If it remained in
further custody of respondent it will definitely damage and hence, order -
ORDER
a. The application is allowed.
b. The respondent is directed to handover the cellular phone mentioned
in the application to the applicant on his furnishing indemnity bond of
Rs.40,000/- (Rupees Forty Thousand Only) before him.
c. The copy of this order be kept in C.R. No.884/2021, registered with
Dharavi Police Station, Mumbai.
