ORDER BELOW APPLICATION FOR RETURN OF PROPERTY
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property.
2. As per applicant the laptop and other things mentioned in the
application is seized by respondent in connection with an offence registered
with respondent police station at C.R. No.931 of 2022, for an offence
punishable under Sections 380, 457 of Indian Penal Code. The
investigating relating to article is completed. Therefore, she filed present
application for handing over custody of stolen article.
3. Say of the respondent was called. The Investigating Officer has no
objection to handover the property to the applicant. The investigating
relating to mobile is completed. If it remained in further custody of
respondent it will definitely damage and hence, order -
ORDER
a. The application is allowed.
b. The respondent is directed to handover the laptop and other things
mentioned in the say of Investigating Officer to the applicant/owner on her
furnishing indemnity bond of Rs.1,02,000/- (Rupees One Lacs Two
Thousand Only) before him.
