ORDER BELOW BAIL APPLICATION, EXH……...
1. Perused record. Heard both the sides.
2. The present application is filed under Section 437 of Code of
Criminal Code, for bail, after filing of charge sheet. The grounds mainly
assigned are, accused is innocent. Investigation relating to him is over.
There are dependents on him. Accused is ready to remain abide by the
conditions. The amount allegedly transferred in his account is already
seized. He is very poor. Offence is triable by this court itself, etc.
3. The Ld. A.P.P. objected to it stating that investigation, though
completed offence is serious. The high amount involved. Earlier bail
applications are rejected. There is possibility of absconding of accused
and tampering of evidence.
4. Accused is in custody since 05.07.2023. Investigation is over and
charge sheet already filed. The record reflects that only partial amount is
transferred in the account of accused and it is already deposited by him.
Main persons are different and accused connected with the allegations
only on the basis of said transaction. The relevant evidence is already
collected. The oral and documentary evidence is of third persons, as such
possibility of tampering is almost nil.
5. Offence is triable by this Court itself. Accused is ready to remain
abide by the conditions. The commencement and conclusion of trial will
take much time. The pre-trial detention can not be allowed further.
Considering all these aspects, reasons assigned in the bail application and
other facts and circumstances, following order -
ORDER
a. Application is allowed.

b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.30,000/-. Permission granted to deposit cash security instead of surety
bond.
c. Accused person shall furnish his detail address and proof thereof.
