REASONS
Both accused are produced before me through video conference.
Charge is framed against them, to which they voluntarily pleaded guilty. Said
accused are in jail since 03.10.2021. Heard accused in person. They submitted
that lenient view may be taken as they are only earning member in their families.
Considering the nature of offence, circumstances under which it is committed,
antecedents of the accused, their age and the period of detention already
undergone, I proceed to pass following order :
ORDER
i) Accused No.1 Sachin Somnath Bodke @ Jadya and accused No.2
Dipesh Sanjay Singh @ Baccha are convicted under section 241 of
Criminal Procedure Code for the offence punishable u/sec. 454 r/w
34 of Indian Penal Code. They are sentenced to suffer R.I. for 45
(Forty Five) days each, and fine of Rs. 200/ (Rupees Two Hundred
only) each, in default of payment of fine, they shall undergo further
S.I. for 2 (Two) days each.
ii) Both accused are convicted under section 241 of Criminal
Procedure Code for the offence punishable u/sec. 457 r/w 34 of
Indian Penal Code. They are sentenced to suffer R.I. for 45 (Forty
Five) days each, and fine of Rs. 200/ (Rupees Two Hundred only)
each, in default of payment of fine, they shall undergo further S.I.
for 2 (Two) days each.
iii) Both accused are convicted under section 241 of Criminal
Procedure Code for the offence punishable u/sec. 380 r/w 34 of
Indian Penal Code. They are sentenced to suffer R.I. for 1 (One)
month each, and fine of Rs. 200/ (Rupees Two Hundred only)
each, in default of payment of fine, they shall undergo further S.I.
for 2 (Two) days each.
iv) All sentences shall run concurrently.
v) Both accused are in jail since 03.10.2021. They are entitled to get
benefit of set off for the period of detention already undergone vide
under section 428 of Cr.P.C.
vi) Seized gold ornaments, mobile phones, T.V., cash of Rs.1530/,
wrist watch be returned to informant, after due verification.
vii) Copy of this judgment be supplied to the accused free of cost.
