ORDER BELOW EXH.01
The complainant and advocate absent. The case is pending
since year 2018. Plea of accused is recorded on 03.01.2020 at Exh.14.
Thereafter, no steps taken to proceed further with the complaint except
filing evidence affidavit which was filed on 13.02.2019. So also no
steps taken to secure presence of the accused by the Complainant from
09.01.2023. It seems that complainant has lost interest in proceeding
with the matter and as such complainant not taking steps nor
remaining present till date. Keeping the file pending years together
without proceeding further taking appropriate steps by the complainant
is unjustified.
2. Considering the year of the case there is reason to believe
that complainant might have lost interest in proceeding with the case.
Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Code of Criminal Procedure and section 279 of
Bharatiya Nagarik Suraksha Sanhita, 2023.
2. Accused are acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
