B.A. NO. 2072/2024 IN C. R. NO. 375/2024 (Bandra P.S.)
1. Perused record. Heard both the sides.
2. The accused prayed for bail mainly on the ground that he is innocent.
Investigation is over and he is ready to remain abide by the conditions, if any,
imposed. No offence punishable under Section 326 of Indian Penal Code made out.
Investigating Officer and Ld. A.P.P. objected to it stating that allegations are
serious. Grievous hurt is caused with dangerous weapon i.e. bamboo stick.
Investigation is in progress and there is possibility of tampering.
3. Accused is in custody since 28.03.2024. Investigation is over. Chargesheet
already filed. From the material produced there appears doubt about the offence
alleged i.e. major offence punishable under Section 326 of Indian Penal Code. As
informed, accused is discharged from the hospital and now out of danger.
Moreover, offence is triable by this Court itself. Accused is ready to remain abide
by the conditions. The conclusion of trial will take much time. Considering all these
aspects and facts and circumstances and reasons assigned in the bail application
following order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of Rs.15,000/-.
Permission granted to deposit cash security instead of surety bond.
c. Time of one month granted for furnishing S.B. and cash security.
d. Accused shall furnish his detail address and proof thereof.
