FOR SUSPENSION OF SENTENCE AND BAIL
Read application moved under section 389 (3) of Code of
Criminal Procedure on behalf of the accused for suspending the
substantive sentence and release him on bail.
2. Section 389(3) of Code of Criminal Procedure, empowers the
court to use the discretion for suspending substantive sentence till
appeal period and releasing the accused on bail. Accused has right to
challenge the impugned Judgment and Order of Conviction passed
against him in Appeal. He was enlarged on regular cash bail of
Rs.15,000/- during trial. He is ready to deposit part amount of fine.
Hence, I pass following order.
ORDER
1) In view of section 389(3) of Code of Criminal Procedure,
substantive sentence ordered against accused shall deemed
to be suspended till appeal period on condition to deposit
part amount of Rs.25,000/- towards fine.
2) The accused is provisionally released on earlier cash bail
amount of Rs.15,000/- deposited by him in the court on
16.08.2018 till appeal period.
3) Order be uploaded on Court Web Portal.
