ORDER BELOW BAIL APPLICATION
IN C. R. NO.25/2025 (Cyber P.S. West Division)
1. Perused record. Heard both the sides.
2. The accused Mr. Sadguru Uttam Dicholkar, prayed for bail mainly
on the ground that he is innocent and has not committed any offence.
Investigation is over and he is ready to remain abide by the conditions. He
is poor and there are dependents on him. Further detention is not justified,
therefore, he shall be released on bail. Investigating Officer and Ld. A.P.P.
objected to it stating that investigation is in progress and there is possibility
of tampering. Offence is serious, huge amount is involved and substantial
stake is transferred to the account of accused, his active involvement
noticed, therefore, application shall be rejected.
3. The summary of the allegations is that certain unknown persons
contacted informant and representing themselves as senior officers of
various enforcement agencies committed fraud on him saying that there is a
crime pending against him and thus, extracted an amount of
Rs.2,04,00,000/-. During investigation it is transpired that out of the said
amount, an amount of Rs.70,00,000/- is transferred into the account of the
applicant. Later on from his account the unknown persons transferred this
amount to other accounts.
4. From the record of investigation it is clear that accused allowed to
use his account for stationing the amount. He is major and can not be said
to be absolutely innocent. The allegations are serious. Material
investigation is incomplete. The other accused persons are yet to be
arrested. At this juncture it can not be said that accused is absolutely
innocent. The grounds assigned are not enough to grant bail. No case of
bail made out. Therefore, following order -
