ORDER BELOW EXH.1
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property. As per applicants the cellular phone
mentioned in the application is seized by respondent. The investigating
relating to it is completed. Therefore, she filed present application for
transferring its custody.
2. Say of the respondent was called. The respondent failed to file his say.
The investigating relating to mobile is completed. If it remained in further
custody of respondent it will definitely damage and hence, order -
ORDER
a. The application is allowed.
b. The respondent is directed to handover the cellular phone mentioned
in the application to the applicant Shabnam Riyazuddin Qureshi @
Shabnam Rahil Shaikh, on her furnishing indemnity bond of Rs.35,000/-
(Rupees Thirty Five Thousand Only) before them.
c. While handing over custody respondent shall assert the identity of
the applicant.
d. The copy of this order be kept in C.R. No.531/2021, registered with
Bandra Police Station, Mumbai.
