ORDER BELOW EXH.01
1. This is an application for condonation of delay of 27 days
caused to file the complaint under section 138 of Negotiable Instrument Act.
2. It is contended that applicant suffered from severe vertigo issue
and was under medical supervision with his doctor and due to the said illness
he could not file present compliant within time. Due to this reason, the delay
has been caused in filing the complaint.
3. The opponent duly served with notice but absent.
4. Heard both sides.
5. The reason shown for delay is probable one and supported by
medical certificate. The delay is satisfied. Further, the delay is not intentional
nor it will take away the statutory right of the complainant/applicant.
Hence, I pass following order.
O R D E R
1) The delay stands condoned subject to costs of Rs.500/-to be
paid to Legal Aid Fund.
2) Costs are condition precedent for registration of the complaint.
3) Order dictated and pronounced in open court.
