Perusal of proceeding shows that already right of accused Nos.2 and 3 to conduct cross examination closed long back. Statement of accused persons to be recorded under section 313 of Code of Criminal Procedure are dispensed with by my Ld. Predecessor. Matter is pending for advancing final arguments and Judgment. Proceeding shows that presence of complainant does not require as matter is posted for final arguments to be advanced by the advocate for complainant. Nobody remaining present for the complainant. However, it would not be just and proper to dismiss the part heard complaint without giving opportunity to the complainant and his advocate. Hence, I pass following order. ORDER 1) The Bail Bonds of the accused Nos.2 and 3 stands cancelled. 2) Issue NBW against the accused Nos.2 and 3 for securing their presence to be served through local Police Station. 3) Issue notices to the sureties of accused Nos.2 and 3 namely Vidya Ravi Nagmoti and Ganesh Babu Shigavan to keep the accused Nos.2 and 3 present on next date. -- 1 of 3 -- 2 Summons Cases SS/1017/2018 Order below Exh.01 4) Matter be posted for advancing final arguments by removing from the caption of dismissal. 5) Complainant and his advocate to remain present for advancing arguments else it will be deemed that complainant has lost interest in the matter and complaint would be dismissed for taking steps. 6) Order dictated and pronounced in open court. 7) Order be uploaded on Court Web Portal for the knowledge of the parties forthwith.
