1. Accused Mr. Sarfaraz Ismail Shaikh, is produced by Investigating
Officer through his representative Shri. Kalyan Bhosale, P.S.I., Bandra P. S.
at 03.35 p.m. No complaint of ill-treatment at the hands of police. Compliance
of Section 47 of Bharatiya Nagarik Suraksha Sanhita, for short B.N.S.S. done.
He is taken into M.C.R. upto 17.05.2025.
2. The accused prayed for bail mainly on the ground that he is poor and
innocent. Investigation is over and he is ready to remain abide by the
conditions, if any, imposed, etc. Investigating Officer and Ld. A.P.P. objected
to it stating that investigation is in progress and there is possibility of
tampering.
3. Accused is in custody for sufficient time. Investigation relating to
accused is over. The stolen property already recovered. Offence is triable by
this Court itself. Accused is ready to remain abide by the conditions. The
conclusion of investigation, filing of charge-sheet and consequent conclusion
of trial will take much time. Considering all these aspects and facts and
circumstances and reasons assigned in the bail application following order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.5,000/-. Permission granted to deposit cash security instead of surety bond.
c. Time of one month granted to furnish S.B./cash security.
d. Accused person shall furnish his detail address and proof thereof.
