ORDER BELOW BAIL APPLICATION
IN C. R. NO.137/2025 (Cyber P.S. West Division)
1. Perused record. Heard both the sides.
2. The accused Mr. Shubham Bajirao Kunjir, prayed for bail mainly on
the ground that he is innocent and has not committed any offence.
Investigation is over and he is ready to remain abide by the conditions, if
any, imposed, etc. Investigating Officer and Ld. A.P.P. objected to it
stating that investigation is in progress and there is possibility of tampering.
Offence is serious. Huge amount is involved. Active involvement of the
accused noticed, therefore, application shall be rejected.
3. The summary of the allegations is that certain unknown persons
contacted informant representing herself as director of his company asked
him to transfer an amount of Rs.1,93,06,000/-, into the another account
furnished by her by committing fraud on him by using fake profile photo,
etc. During investigation it is transpired that the whole amount is
transferred into the account of the applicant Mr. Shubham Bajirao Kunjir.
Later on from his account the unknown persons transferred this amount to
other accounts. It is also transpired that applicant allowed such transfer of
huge amount in his account for certain commission.
4. It is claimed that as per investigating agency itself applicant only
allow the transfer of amount in lieu of certain commission. He is innocent.
However, it is very difficult to believe that such huge amount has been
transferred without knowing it’s whereabouts. The allegations are very
serious. In the alternative even if it is considered that there is some
substance in the contentions, such inference can not be drawn at this very
initial stage as material investigation is incomplete. The amount involved is
very high. The other accused persons are yet to be arrested. In these
background facts and circumstances, it can not be said that applicant is

absolutely innocent and grounds assigned are enough to grant bail. No case
of bail made out. Therefore, following order -
ORDER
Application is rejected.
