ORDER BELOW EXH.1
1. Perused record and verification. Heard learned advocate for the
complainant. It is alleged that accused, approached complainant for hand loan
and the amount of Rs.17,24,200/- is given to him by complainant. Complainant
contacted him repeatedly but he repaid only amount of Rs.1,20,000/- and not
ready to repay the remaining amount. Complainant is having strong feeling that
with malafide intention accused gave false promises of repayment to her. But
those promises bore no fruits and hence, initially complainant approached
police and then to this court, as no action taken.
2. On perusal of complaint, verification and other evidence, it is clear that
it is purely a case of failure of promises accruing civil liability to be enforced
against accused. The element of intention to defraud for wrongful gain to one
person and wrongful loss to another, is totally missing. Though stray word of
cheating is used, the allegations are vague. No case made out. Therefore,
following order -
ORDER
Complaint is dismissed.
