ORDER BELOW EXH.1
1. Perused record. Accused pleaded guilty to the offence. The
consequences pertaining to possible punishment made understand to the
accused. Despite that accused is ready to plead guilty and as such his plea is
voluntary.
2. Accused submitted that he is poor and innocent person. His conduct is
not willful. Further, he is ready to remain abide by the condition and will not
commit such act again. Therefore, leniency shall be shown to him while
awarding punishment.
3. Accused is of tender age. He appears poor, his conduct seems to be not
deliberate. Further, he is ready to remain abide by the condition. It is alleged
that accused committed the theft of cash of Rs.5,100/- and it was already
seized from him. Allegations are not much serious. Considering all these
aspects and grounds pleaded for leniency, I am of the opinion that rather than
awarding substantive sentence, mere admonition will serve the cause of
justice. Accordingly, order -
ORDER
a. Accused is convicted under Section 252 of Code of Criminal
Procedure, for an offence punishable under Section 379 of Indian Penal Code,
and released on admonition that he shall not commit such act again.
b. Accused shall furnish undertaking to that effect.
c. The seized property shall be handed over to its owner, retaining its
photographs. The matter is disposed off.
c. Cash security deposited shall be refunded after appeal period.
d. Copy of this order shall be given free of cost to accused
