ORDER PASSED BELOW EXH.1 This application is filed by the applicant namely Mr. Amit Kumar Verma for release of autorickshaw bearing No.MH02EF5734, which is seized by the Kherwadi police station in connection with Crime No.400/2021 registered with the said police station for the offence punishable under section 379 of IPC. 2) Say was called from I. O. and A.P.P. IO has no objection. But, the Ld. APP has an objection and submitted that it is essential at the time of trial and it is used in the commission of crime. She prayed for rejection. 3) In support of his contention regarding ownership, applicant has filed on record xerox copies of FIR, statement, permit, PUC certificate & insurance certificate and verified copies of RC Book, fitness certificate, driving licence & Aadhar card alongwith his affidavit. The applicant failed to show that he is the registered owner of said autorickshaw. The name on RC book is Amarnath Rajkumar Verma, which is not the name of applicant.
