REASONS
Accused is produced before me through video conference. Charge is
framed against him, to which he voluntarily pleaded guilty. Accused is in jail since
18.04.2022. Heard accused in person. He submitted that lenient view may be
taken as he is only earning member in his family. Considering the nature of
offence, circumstances under which it is committed, antecedents of the accused, his
age and the period of detention already undergone, I proceed to pass following
order :
ORDER
i) Accused Vishal Singh @ Amnesh Rajesh Singh is convicted under
section 241 of Criminal Procedure Code for the offence punishable
u/sec. 380 of Indian Penal Code. He is sentenced to suffer R.I. for
Two (2) months, and fine of Rs. 100/, in default of payment of fine,
he shall undergo further S.I. for One (1) day.
ii) Accused is convicted under section 241 of Criminal Procedure Code for
the offence punishable u/sec. 142 of Maharashtra Police Act and he is
sentenced to suffer R.I. for Two (2) months and fine of Rs.100/, in
default of payment of fine, he shall undergo further S.I. for 1 days.
iv) Both sentences shall run concurrently.
v) Accused is in jail since 18.04.2022. He is entitled to get benefit of set
off for the period of detention already undergone vide under section
428 of Cr.P.C.
vi) Seized Realmi company mobile phone be returned to its original
owner, after due verification.
vii) Copy of this judgment be supplied to the accused free of cost.
