ORDER BELOW APPLICATION FOR REGISTRATION OF DEATH

1] This is an application filed by applicant Saira Bano
Rahiman Shah Patel for registration of death of her mother namely
Late Halima Abdullah Patel (female) who was died at home address
on 03.09.2020 and said death was not registered. Therefore she
prayed for direction to G/North Ward of Municipal Corporation of
Greater Mumbai for registration of death of his mother.
2] The respondent i.e. Medical Officer of Health, G/North
Ward, Dadar W, Mumbai has filed report (Exh.03-A) and submitted that
the death of Late Halima Abdullah Patel (female) not been registered
in his office. The said officer further submitted that to scrutinize the
case and necessary order be passed.
3] Alongwith this application, the applicant has filed on
record her affidavit(Exh.1-A) stating therein every facts as per her
application and enclosed copies of her Aadhar Card as well as copy of
Medical Certificate of Cause of Death of deceased, statement of Death
Registry i.e. permission for burial and death report copy of ration card,

and copy of Aadhar card of deceased mother as proof of their identity
and address. Paper publication came to be done in English daily
newspaper namely ' News Hub '(Exh.06) dated 15/09/2023 and
Marathi daily newspaper namely 'Pratahkal' (Exh.05) dated
15/09/2023 thereby no objection came to be filed from public at large
showing any objection to the claim of the applicant regarding death of
her mother on concerned date. The applicant has also submitted joint
affidavit of the witnesses Bismillah Bachumiya Sayed and Fatima
Rahiman Shah Patel (Exh.02) stating therein that they have present at
the time of death of said Late Halima Abdullah Patel (female). In
view thereof it will be proper to accept contention of the applicant
regarding death of her mother namely Late Halima Abdullah Patel
(female) on 03.09.2020 as true and correct. Hence,it will be proper to
direct the respondent to register death of mother of the applicant in
concerned register. Hence, I proceed to pass following order.
ORDER
1 The application is allowed.
2 The concern authority 'The Registrar, Birth and Death,
G/North Ward, Dadar (W), Mumbai – 400 028' is directed to take entry
of the date of death of Late Halima Abdullah Patel (female) as
03.09.2020 (Third September Two Thousand Twenty ) at home at 68-
H, Pathan Manzil, 2nd Floor, Room No.20, Cadell Road, Veer Savarkar
Marg, Mahim(W),Mumbai- 400 016 in his register on accepting the
fees as per the rules.
