ORDER BELOW APPLICATION FOR RETURN OF PROPERTY IN
C.C.NO.422/N/2022 OF BKC POLICE STATION.
1. Applicant/ accused Onkar Mahinder Singh filed this
application for return of passport bearing no. S5231911 seized by BKC
Police station in CC.No. 321/PW/2022 registered u/sec. 420, 465, 467,
468, 471, 120B of IPC.
2. Respondent and APP opposed the application.
3. Admittedly the seized document is not used for the
commission of the alleged offence. The seized document is not the
offending document. IO has not applied to the passport authority for
taking any action. Seized document is not required for investigation.
Keeping the seized document in custody of the police station for further
period is not necessary. Thus, it will be proper to return the same to the
applicant. Applicant is ready to abide by the conditions that may be
imposed on him. In the result, following order is passed:
ORDER
1. Application is allowed.
2. The custody of passport bearing no. S5231911 seized by BKC
Police station in CC.No. 321/PW/2022 registered u/sec. 420,
465, 467, 468, 471, 120B of IPC be handed over to the
applicant/ accused.
3. Applicant/ accused is directed to produce the said document as
and when required by this court.
4. Applicant/ accused should obtain prior permission of this court
before traveling abroad.
