ORDER BELOW
(Application for Return of Property)
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property.
2. As per applicant after incidence of theft by online trnasfer, she
approached Cyber Police Station and the offence at C.R. No.8 of 2021
was registered for offence punishable under Section 419, 420, 34 of
Indian Penal Code r/w.66-a, 66-d of Cyber Crime Act against accused
persons. Later on during investigation recoveries of stolen articles were
made. She is in need of the recovered cash, therefore this application. Say
of the I.O. and Ld. A.P.P. was called. They have no objection to handover
the said property.
3. Investigation relating to property is over. From the say of
Investigating Officer it is clear that applicant is legal claimant of the
property. Therefore, following order -
ORDER
a. The respondent is directed to handover the cash of Rs.30,000/-
(Rupees Thirty Thousand Only) to the applicant on her furnishing
indemnity bond of Rs.30,000/- (Rupees Thirty Thousand Only).
b. While handing over cash the respondent shall retain the details of
denominations and numbers of the currency notes and also panchnama
shall be prepared.
