This application is filed by the applicant namely Mrs. Pooja
Shivajirao Chame for release of Activa 3 G motorcycle bearing No.MH46
AN1240 which is by the Kherwadi police station in connection with Crime
No.469/2022 registered with the Kherwadi police for the offence
punishable under section 379 of IPC.
2) Say was called from I. O. and A.P.P. The I.O. has no objection.
The Ld. APP has an objection and submitted that said muddemal is required
at the time of trial. She prayed for rejection.
3) In support of his contention regarding ownership, applicant has
filed on record verified copy of Aadhar card, copy copy of tax invoice,
registered vehicle details, FIR & statement alongwith his affidavit. Applicant
failed to file verified or original copy of RC book of motorcycle on record.
Therefore, he is not entitled to get the custody of seized muddemal. Under
such circumstances, I pass following order :
