REASONS
Accused is produced before me through video conference. Charge is
framed against him, to which he voluntarily pleaded guilty. Said accused is in jail
since 26.04.2022. Heard accused in person. He submitted that lenient view may
be taken as he is only earning member in his family. Considering the nature of
offence, circumstances under which it is committed, antecedents of the accused, his
age and the period of detention already undergone, I proceed to pass following
order : ORDER
i) Accused Sachin Somnath Bodke @ Jadya is convicted under
section 241 of Criminal Procedure Code for the offence punishable
u/sec. 454 of Indian Penal Code. He is sentenced to suffer
imprisonment for the period of detention, which he already
undergone, and fine of Rs. 200/ (Rupees Two Hundred only), in
default of payment of fine, he shall undergo further S.I. for 2 (Two)
days.
ii) Accused is convicted under section 241 of Criminal Procedure Code
for the offence punishable u/sec. 457 of Indian Penal Code. He is
sentenced to suffer imprisonment for the period of detention, which
he already undergone, and fine of Rs. 200/ (Rupees Two Hundred
only), in default of payment of fine, he shall undergo further S.I.
for 2 (Two) days .
iii) Accused is convicted under section 241 of Criminal Procedure Code
for the offence punishable u/sec. 380 of Indian Penal Code. He is
sentenced to suffer imprisonment for the period of detention, which
he already undergone, and fine of Rs. 200/ (Rupees Two Hundred
only), in default of payment of fine, he shall undergo further S.I.
for 2 (Two) days.
iv) All sentences shall run concurrently.
v) Accused is in jail since 26.04.2022. He is entitled to get benefit of
set off for the period of detention already undergone vide under
section 428 of Cr.P.C.
vi) Seized silver ornaments, silver idol and utensils be returned to
original owner, after due verification.
vii) Copy of this judgment be supplied to the accused free of cost.
